TRANSPORTATION SUPPORT TERMS, LIMITATIONS & LIABILITY PROTECTIONS
Emergent Mental Health Services LLC (EMHS)
Emergent Mental Health Services LLC (“EMHS”) provides limited, non-emergency transportation support solely as an access-assistance service. Transportation support is ancillary, voluntary, and not a guaranteed component of care.
Use of EMHS transportation support constitutes acknowledgment and acceptance of the following terms.
No Emergency, Medical, or Crisis Transportation
EMHS transportation support is not:
- Emergency transportation
- Medical transportation
- Crisis response or stabilization
- A substitute for 911, mobile crisis teams, or emergency departments
If an individual is experiencing a medical or psychiatric emergency, EMHS transportation will not be provided, and emergency services must be contacted.
No Guarantee of Availability or Continuity
Transportation support:
- Is provided only when operationally feasible
- Is not guaranteed, even if previously provided
- May be modified, delayed, rescheduled, or discontinued at any time
- May be unavailable due to staffing, routing, safety, weather, vehicle issues, or operational constraints
EMHS has no obligation to provide transportation:
- For any specific appointment
- On any specific date or time
- For return transport if services are declined, shortened, or discontinued
Approved Pickup Locations Only
No Residential or Door-to-Door Pickups
Transportation support is limited to:
- Pre-approved community pickup hubs
- Public transit centers or bus stations
- Designated public locations identified by EMHS
- EMHS clinic location
Residential, private home, or door-to-door pickups are not provided under any circumstances.
Individuals are solely responsible for arriving at the designated pickup location on time.
Designated Routes & Shared Transportation
Transportation:
- Is route-based, not individualized
- May be shared with other individuals
- May include indirect routing and multiple stops
Pick-up and drop-off times are approximate only. EMHS does not guarantee:
- Exact arrival or departure times
- Direct routes
- Minimal travel duration
- On-demand or custom scheduling
Peer Support Services During Transportation (AHCCCS-Scoped)
EMHS transportation routes may include the presence of a Peer Support Specialist providing services within their AHCCCS-approved scope of practice.
Peer Support Specialists may:
- Engage in voluntary peer support activities consistent with AHCCCS requirements
- Provide recovery-oriented engagement, encouragement, and resource connection
- Support access to care and service linkage upon arrival at the clinic
Peer Support Specialists do not:
- Provide clinical services, therapy, or medical care
- Provide crisis intervention or emergency response
- Monitor, supervise, or assume responsibility for passenger safety during transport
- Determine fitness for transport or service eligibility
Peer support services during transportation:
- Are non-clinical and non-custodial
- Do not constitute supervision, monitoring, or stabilization
- Do not create a duty to intervene beyond AHCCCS peer support scope
Participation in peer interaction during transportation is voluntary and may be declined at any time.
Re-Entry & Correctional Facility Release Pickups
EMHS may provide transportation support for individuals after official release from correctional or detention facilities, subject to availability and coordination.
Important limitations:
- Transportation is provided only after release has occurred
- EMHS does not enter secure or custody areas
- EMHS staff do not assume custody, supervision, or monitoring responsibility
- EMHS does not influence or coordinate release timing
Pickups are limited to:
- Designated public release locations
- Pre-approved pickup points outside correctional facilities
- Transport to the EMHS clinic only
EMHS is not responsible for:
- Release delays or administrative issues
- Missed pickups due to release timing changes
- Post-release supervision, compliance, or outcomes
Public Transit & Bus Station Pickups
Transportation support may include pickups at:
- Public bus stations
- Transit centers
- Other designated public transportation hubs
Conditions:
- Individuals must independently arrive at the pickup location
- EMHS does not wait, monitor, or supervise prior to pickup
- Missed pickups due to late arrival are the individual’s responsibility
No Duty to Transport, Supervise, or Monitor
Drivers and transportation staff:
- Are not clinicians
- Do not provide therapy, crisis counseling, or medical monitoring
- Do not supervise or assess individuals beyond basic transport safety screening
Transportation support does not create:
- A custodial relationship
- A therapeutic relationship
- A special duty of care
- An obligation to continue transport if safety concerns arise
Safety-Based Denial or Termination of Transport
Transportation may be refused or terminated immediately, at EMHS’s sole discretion, if an individual:
- Poses a safety risk to themselves, others, or staff
- Is medically or psychiatrically unstable
- Is aggressive, threatening, or disruptive
- Is under the influence to a degree that creates safety risk
- Refuses to follow vehicle or staff instructions
Such refusal or termination does not constitute abandonment and does not obligate EMHS to provide alternative transportation.
Client Responsibilities & Assumption of Risk
Individuals using transportation support agree to:
- Arrive on time to the designated pickup location
- Follow all driver and staff instructions
- Wear seatbelts and comply with vehicle safety rules
- Conduct themselves respectfully
Individuals assume all risks associated with:
- Shared transportation
- Delays or rerouting
- Entering and exiting vehicles
- Personal belongings
EMHS is not responsible for lost, stolen, or damaged personal property.
Confidentiality Limitations
While EMHS staff follow confidentiality standards:
- Privacy cannot be guaranteed in shared transportation
- Conversations may be overheard
- Individuals should limit personal disclosures during transport
Photography, video, or audio recording in EMHS vehicles is prohibited.
Limitation of Liability
To the fullest extent permitted by law:
- Transportation is provided “as-is” and “as available”
- EMHS is not liable for delays, missed appointments, or service interruptions
- EMHS is not liable for indirect, incidental, or consequential damages
Use of transportation support is voluntary and at the individual’s discretion.
Modification or Discontinuation of Services
EMHS reserves the exclusive right to:
- Modify routes, pickup locations, and schedules
- Suspend or discontinue transportation services
- Update these terms at any time without prior notice
Discontinuation of transportation does not affect eligibility for clinical services.
